The Solicitor  also claims he  obtained a stay of bankruptcy proceedings which means he has every standing in the court. Eberts told you what do , and he having seen all your papers said there was no judgment against you, yet you keep referring in the courts  to the Judgment against you. So there was no liquidated debt , but there is a question as to whether you asked for the solicitors costs to be taxed or not, and if you did, were these costs taxed before the bankruptcy hearing? What happened at any  leave to appeal, etc ? I have told you what to do, you were  wrongly made bankrupt in the High Court , that is the Court you should be in.    Further you  said you obtained a stay  of Bankruptcy  proceedings from Registrar Baister . A stay is a stay until the stay is lifted ( or until its end date ). The fact that you allowed the Trustee to make applications and have hearings and obtain more costs despite the stay  ,  is your fault . The solicitor had every right to speak at the County Court hearing  before Judge Oppenheimer. It may well be the in the future the solicitor will  loose his appeal and be  bankrupt .   I note yet again  you are repeating  "The stay of proceeding does not mean he has locus standi to bring the application made to court. " Who told you this nonsense ? At the hearing on 9 November 2009, HHJ Oppenheimer said Unless any person having locus standi to act for the Claimant firm applies from relief for sanction by 4p.m. on 23rd November 2009, the judgment of 16th February 2004 shall at 4 p.m. on 23rd November 2009 stand set aside. I was ordered  to serve a copy of the order on the Official Receiver of Mr Mehdad Jami Tehrani case no 3143 of 2009 and on Messrs Russell Cooke Solicitors.  I complied with the order and filed a certificate of service.  Neither Russell Cooke or the Official Receiver objected to the order.  I do not understand why the course of action was changed on the basis of an application from the bankrupt Mr Tenrani. Mr Tehrani, a bankrupt, on 13 November 2009, filed an application to set aside this order.  On the Application Notice he misled the court, claiming he had locus.  During the hearing Mr Tehrani said he had obtained a new practising certificate on 3 December 2009.  The certificate he supplied after the judgment was one he had applied for in October 2009, not a copy of one issued after the bankruptcy  was made. Dean & Dean solicitors has been closed by the SRA and does not exist.  Mr Tehrani was made bankrupt on 5 November 2009.  The stay of proceeding does not mean he has locus standi to bring the application made to court. I have been in touch with the SRA and have been reassured that, as stated, Mr Tehrani and Mr Mireskandari will both be going before the Solicitors Disciplinary Tribunal.
